1. Definitions

In these terms, the following definitions apply:

•Supplementary Agreement: An agreement whereby the consumer acquires products, digital content, and/or services related to a distance contract, and these items are supplied by the entrepreneur or a third party based on an arrangement between the third party and the entrepreneur.

•Cooling-off Period: The period during which the consumer can exercise their right of withdrawal.

•Consumer: A natural person not acting for purposes related to their trade, business, craft, or professional activity.

•Day: A calendar day.

•Digital Content: Data produced and supplied in digital form.

•Continuous Performance Contract: An agreement for the regular supply of goods, services, and/or digital content over a period of time.

•Durable Data Carrier: Any device, including email, enabling the consumer or entrepreneur to store information addressed personally to them in a way that allows future access and use for a period appropriate for the purpose of the information, and which allows unaltered reproduction of the stored information.

•Right of Withdrawal: The consumer’s option to withdraw from the distance contract within the cooling-off period.

•Entrepreneur: The natural or legal person who is a member of Thuiswinkel.org and offers products, digital content, and/or services to consumers at a distance.

•Distance Contract: A contract concluded between the entrepreneur and the consumer within the framework of an organized system for distance sales of products, digital content, and/or services, whereby, up to and including the conclusion of the contract, exclusive or joint use is made of one or more means of remote communication.

•Model Withdrawal Form: The European model withdrawal form included in Appendix I of these terms. Appendix I does not need to be provided if the consumer has no right of withdrawal for their order.

•Means of Remote Communication: Any tool used for concluding a contract without the consumer and entrepreneur being physically present in the same space at the same time.

3. Applicability

These general terms and conditions apply to every offer made by the entrepreneur and every distance contract established between the entrepreneur and the consumer.

1.Before a distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If providing this text is not reasonably possible, the entrepreneur will indicate how the terms can be reviewed and that they will be sent free of charge at the consumer’s request.

2.If the distance contract is concluded electronically, the text of these terms can be provided electronically in such a way that the consumer can easily save them on a durable data carrier.

4. The Offer

1.If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

2.The offer contains a complete and accurate description of the products, digital content, and/or services. The description is detailed enough to allow the consumer to properly assess the offer.

3.Apparent errors or mistakes in the offer are not binding for the entrepreneur.

5. The Contract

1.The contract is established once the consumer accepts the offer and meets the specified conditions.

2.If the consumer accepts the offer electronically, the entrepreneur must confirm receipt of this acceptance without delay.

6. Right of Withdrawal

1.The consumer may dissolve a contract regarding the purchase of a product within a 14-day cooling-off period without providing any reason.
